These Terms apply to FlowForge Tech and its business-to-business software services. The Service is intended only for businesses and their authorized users acting on the business's behalf.
1. Acceptance and Eligibility
By accessing or using the Service, you agree to these Terms on behalf of yourself and the business you represent. If you do not have authority to bind that business, you must not use the Service.
The Service is offered for business use only. It is not intended for personal, family, or household use.
2. Accounts and Authorized Users
You are responsible for the information in your account, for keeping credentials secure, and for making sure only authorized users access the Service.
You must provide accurate, current information and promptly update it if anything changes.
3. Platform Use and Customer Data
FlowForge Tech provides software for service businesses to manage customers, jobs, schedules, operational records, and related workflows. You retain ownership of your customer data, job records, and other content that you provide or import into the Service.
You represent that you have the rights and permissions needed to submit, store, and process that information through the Service, and you grant us a limited license to host, process, transmit, and display it only as needed to operate the Service.
4. Payments and Stripe
If your account includes billing, invoice, or subscription features, payment data is handled by Stripe and not stored by FlowForge Tech on our own systems. We may receive limited payment status information, such as confirmation that a payment succeeded or failed, so we can maintain account records.
Stripe processes payment information under its own terms and privacy practices.
5. Acceptable Use
You may not use the Service to violate law, compromise security, interfere with service operation, or access data you are not authorized to access.
- Do not attempt to probe, scan, reverse engineer, or bypass platform controls.
- Do not upload malware, harmful code, or fraudulent content.
- Do not use the Service in a way that could disrupt other customers or users.
- Do not misrepresent your identity or your authority to act for a business.
6. Smith AI
Smith AI is an optional assistive feature that a company administrator may enable for all or selected authorized users. The company administrator represents that they have authority to enable the feature and permit relevant company, customer, job, and form data to be processed by FlowForge Tech and our AI service providers to produce responses.
AI-generated output may be incomplete, inaccurate, or inappropriate. Smith AI does not replace human judgment, professional advice, or your organization's review and approval processes. You and your organization remain responsible for reviewing and verifying information before it is saved, submitted, or acted upon. Do not rely on Smith AI for safety-critical, legal, financial, medical, or other professional decisions, and do not submit information you are not authorized to share.
We may restrict or suspend Smith AI for a company or user when needed for security, safety, legal, or operational reasons. Suspending Smith AI does not suspend access to the rest of the Service.
7. Service Changes, Suspension, and Termination
We may change, suspend, or discontinue any part of the Service at any time. We may also suspend or terminate access if we believe a user, account, or activity presents a security risk, violates these Terms, or creates legal or operational risk.
8. Intellectual Property and Feedback
The Service, including our software, branding, and content we provide, is owned by FlowForge Tech or our licensors. Other than the rights expressly granted in these Terms, no ownership rights are transferred to you.
If you give us suggestions or feedback, you grant us a perpetual, worldwide, royalty-free right to use that feedback without restriction.
9. Disclaimers and Liability
The Service is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, FlowForge Tech will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim will not exceed the amounts you paid to us for the Service during the 12 months before the event giving rise to the claim, or 100 USD if no fees were paid.
10. Disputes and Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute that cannot be resolved informally within 30 days will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with the arbitration seat in Volusia County, Florida.
You and FlowForge Tech waive any right to a jury trial and agree that any claim must be brought on an individual basis, not as a class, consolidated, or representative action. Either party may seek temporary or preliminary injunctive relief in court to protect confidential information or intellectual property, and either party may bring an individual claim in small claims court if it qualifies.
